73% of Gym Complaints Are Billing Issues. Are You Exposed?

A practical compliance checklist covering contracts, waivers, accessibility, and privacy — so legal gaps don't become expensive problems.

Compliance Is a Business Problem, Not Just a Legal One

Most gym owners don't lose sleep over legal exposure — until a chargeback dispute turns into a regulatory complaint, or a waiver that was never reviewed fails in court. The risks are predictable and largely preventable. The question is whether you've built systems to stay ahead of them or you're reacting after the fact.

Billing and Contracts: Where Most Trouble Starts

A 2025 Connecticut consumer-protection report found that 73% of health-club complaints were about billing — cancellations, freezes, duplicate charges, and fees. That's not a legal anomaly. That's a systems failure showing up in regulatory data.

Your membership agreement needs to spell out, in plain language: price, billing frequency, minimum term, cancellation method, notice period, freeze rules, early-termination fees, and auto-renewal terms. Hiding these in fine print isn't just bad practice — it's a liability trigger.

  • Require cancellation through at least one documented channel: email, member portal, or an in-person form

  • Issue written confirmation within 2–3 business days

  • Audit failed payments and cancellation records monthly

  • Never continue billing after a confirmed cancellation

Waivers Don't Replace Safe Operations

A waiver is one layer of protection — not a substitute for running a safe facility. Waivers should be activity-specific, written in plain language, signed before participation, and reviewed for your jurisdiction. The QK Fitness case is a useful reminder: even where an exclusion clause exists, failing to take reasonable steps to warn members can undermine legal protection entirely.

Pair your waivers with dated inspection logs, documented incident reports, and staff trained to record every detail: date, time, witnesses, equipment involved, first aid given, and follow-up actions taken. An incident report is not an admission of fault. Not creating one is far more dangerous.

Accessibility, Workplace Safety, and Privacy

Under Title III of the ADA, most gyms qualify as public accommodations. That means entrances, bathrooms, reception areas, and equipment layout need to meet accessibility standards — including roughly 30 by 48 inches of clear floor space around relevant equipment.

On privacy: collect only the health data you actually need, restrict access by role, use secure payment systems, and define how long you retain member data before deletion. Before using testimonials, before-and-after photos, or promotional emails, get written consent. Avoid any claims about weight loss, medical outcomes, or injury prevention unless you can substantiate them.

Your 30-Day Compliance Reset

  • Week 1: Have local counsel review contracts, waivers, privacy notices, and marketing claims

  • Week 2: Test your cancellation and freeze workflows using a staff mystery-member exercise

  • Week 3: Complete an accessibility and equipment-risk walkthrough; fix high-risk defects first

  • Week 4: Build one incident-response form and train every employee to use it immediately

Then set a quarterly calendar for billing audits, certification renewals, equipment inspections, complaint reviews, and data-access checks. Insurance doesn't replace compliance — insurers routinely deny claims after preventable policy breaches. Build the systems now, before you need them.
